The terms governing your use of Next Key Mortgage’s website, SMS communications, email program, video meetings, social media, and mortgage services.

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Next Key Mortgage (“Next Key Mortgage,” “we,” “our,” or “the Company”), a licensed mortgage broker.

By accessing our website, submitting a mortgage application, using our SMS or email services, joining a Zoom meeting, or interacting with our social media pages, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

📋 If you do not agree to these Terms, do not use our website or services. These Terms apply to all visitors, users, and applicants.

2. Description of Services

Next Key Mortgage operates as a licensed mortgage broker, not a direct lender. Our services include:

  • Mortgage brokerage services connecting borrowers with lenders from our network of 250+ wholesale lenders
  • Loan pre-qualification and pre-approval assistance
  • Mortgage consultation services via phone, email, and video conference
  • SMS and email communications regarding mortgage rates, programs, and your application
  • Educational content and mortgage calculators on our website (for informational purposes only)
  • Referrals to licensed real estate agents, title companies, and other settlement service providers

🏦 Broker Disclosure: As a mortgage broker, Next Key Mortgage arranges loans between borrowers and lenders. We are compensated by lenders through lender-paid compensation. This compensation structure will be disclosed in your Loan Estimate and Closing Disclosure as required by RESPA and Regulation X.

3. Eligibility

To use our services and apply for a mortgage through Next Key Mortgage, you must:

  • Be at least 18 years of age (or the age of majority in your state)
  • Be a legal resident or citizen of the United States, or an eligible non-citizen with appropriate immigration status
  • Have a valid Social Security number or Individual Taxpayer Identification Number (ITIN)
  • Be applying for a property located in a state where Next Key Mortgage is licensed to originate loans
  • Agree to provide accurate, complete, and truthful information on all application materials

We reserve the right to refuse service to anyone for any lawful reason, including providing false information or attempting to circumvent our policies.

4. No Loan Guarantee

Mortgage rates, loan programs, and terms shown on our website are for illustrative purposes only and are subject to change without notice. The rates you are offered will be determined by the lender based on your creditworthiness, property type, loan-to-value ratio, and market conditions at the time of locking your rate.

The mortgage calculator available on our website provides estimates only. Actual payments, interest rates, fees, and costs may differ significantly based on your individual circumstances.

⚠️ No Loan Guarantee: Submitting a mortgage application, receiving a pre-qualification estimate, or receiving a pre-approval letter does not guarantee loan approval or funding. All loans are subject to final underwriting approval, appraisal results, title clearance, satisfactory verification of all submitted information, and the lender’s final credit decision.

5. Mortgage Application Terms

5a. Accuracy of Information

You represent and warrant that all information provided on your mortgage application and supporting documents is true, accurate, complete, and current. Providing false or misleading information on a mortgage application is a federal crime under 18 U.S.C. § 1014 and may result in criminal prosecution, fines, and imprisonment.

5b. Application Fees

Next Key Mortgage does not charge upfront application fees for submitting a mortgage application. However, certain lender-required costs (such as appraisal fees, credit report fees, and rate lock fees) may be collected after you receive and acknowledge your Loan Estimate. These costs will be fully disclosed before you are obligated to pay them.

5c. Loan Estimate & Closing Disclosure

You will receive a Loan Estimate within three business days of submitting your complete application as required by RESPA. A Closing Disclosure will be provided at least three business days before consummation of your loan. These documents describe all loan terms, fees, and costs.

5d. Required Documentation

You authorize Next Key Mortgage to request and obtain all documentation reasonably necessary to process your application, including employment verification, income verification, asset verification, property appraisals, title searches, and insurance documentation.

5e. Application Withdrawal

You may withdraw your mortgage application at any time before loan consummation by contacting us in writing. Withdrawal does not obligate you to pay for services not yet rendered, except for third-party costs already incurred (e.g., appraisal fees) that were disclosed in your Loan Estimate.

6. Credit Authorization & FCRA Disclosure

By submitting a mortgage application, you authorize Next Key Mortgage and any lender partners to obtain your credit report from one or more credit reporting agencies (Equifax, Experian, TransUnion) in connection with your application.

6a. Hard Credit Inquiry Disclosure

📊 This is a hard credit inquiry. A full pre-approval involves a hard pull on your credit, which may temporarily lower your credit score. Multiple mortgage inquiries within a 14–45 day window are typically treated as a single inquiry by most scoring models under the FCRA rate-shopping provision.

6b. Fair Credit Reporting Act (FCRA) Rights

You have the following rights under the FCRA:

  • The right to know if your application is denied based in whole or in part on information in your credit report
  • The right to receive an Adverse Action Notice if your application is denied, along with the name and contact information of the credit bureau that provided the report
  • The right to a free copy of your credit report within 60 days of receiving an adverse action notice
  • The right to dispute inaccurate information directly with the credit bureaus

6c. Adverse Action Notice

If your loan application is denied, we will provide you with an Adverse Action Notice within 30 days of the decision as required by ECOA and the FCRA. This notice will explain the specific reasons for denial and your rights to obtain a free credit report.

7. SMS / Text Message Terms (Twilio)

Next Key Mortgage uses Twilio to send text messages. By opting in to our SMS program, you agree to the following terms in compliance with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and Twilio’s Acceptable Use Policy.

7a. Express Written Consent

You agree that by checking the consent box on our opt-in form and submitting your mobile number, you are providing your express written consent to receive autodialed or prerecorded text messages from Next Key Mortgage at the mobile number provided. Consent is evidenced by your checkbox selection, the date and time stamp, and the IP address of the device used.

7b. Consent Is Not a Condition

Consent to receive text messages is never a condition of obtaining a mortgage or any other product or service from Next Key Mortgage.

7c. Message Frequency & Content

Message frequency varies. You may receive up to 8 messages per month. Messages may include: rate alerts, application status updates, document requests, appointment reminders, loan program announcements, and general mortgage market information.

7d. Message & Data Rates

Standard message and data rates may apply depending on your mobile carrier plan. Next Key Mortgage is not responsible for charges imposed by your carrier.

7e. Opt-Out Instructions (STOP)

To stop receiving text messages, reply STOP to any message at any time. You will receive one final confirmation text. You will then receive no further marketing messages. Transactional messages related to your active application may continue as permitted by applicable law.

7f. Help Instructions

Reply HELP to any message to receive assistance. You will receive: Next Key Mortgage: For help call (470) 457-6149 or email info@main.nextkeymortgage.com. Msg&data rates may apply. Reply STOP to cancel.

7g. Supported Carriers

Supported carriers include but are not limited to: AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, Cricket Wireless, and US Cellular. Carrier support may vary and is subject to change.

7h. Twilio Platform Terms

SMS delivery is facilitated through Twilio, Inc. By using our SMS services, you acknowledge that Twilio’s Terms of Service and Privacy Policy also apply to your communications.

8. Email Communication Terms (Brevo)

Next Key Mortgage uses Brevo (formerly Sendinblue) to send transactional and marketing emails. By providing your email address and subscribing, you agree to these terms in compliance with the CAN-SPAM Act, CASL, and Brevo’s Anti-Spam Policy.

8a. Email Consent

By submitting your email address through our website, application, or opt-in form, you consent to receiving email communications from Next Key Mortgage. Marketing emails will only be sent with your affirmative consent. Transactional emails (application updates, document requests, required regulatory disclosures) may be sent without marketing consent as they are necessary to service your loan.

8b. CAN-SPAM Compliance

  • All marketing emails will clearly identify Next Key Mortgage as the sender
  • Subject lines will accurately describe email content
  • Our physical business address will be included in all marketing emails
  • A clear, functioning unsubscribe link will be included in every marketing email
  • Unsubscribe requests will be honored within 10 business days

8c. Email Unsubscribe

To unsubscribe from marketing emails, click the “Unsubscribe” link in any email footer, or email us at info@main.nextkeymortgage.com with “Unsubscribe” in the subject line. Unsubscribing from marketing emails will not affect transactional communications related to your active application.

8d. Brevo Platform Terms

Email delivery is facilitated through Brevo. By using our email services, you acknowledge that Brevo’s Terms of Use and Privacy Policy also apply.

9. Video Meeting Terms (Zoom)

Virtual consultations, loan reviews, and educational webinars conducted by Next Key Mortgage may use Zoom Video Communications. By joining a Zoom meeting or webinar hosted by us, you agree to the following:

9a. Recording Consent

Sessions may be recorded for quality assurance, training, and regulatory compliance purposes. You will be notified at the beginning of any recorded session. If you do not consent to recording, you may request that recording be disabled. If recording is required for regulatory compliance, you may choose to discontinue the meeting.

9b. Conduct During Meetings

You agree to conduct yourself professionally during all video meetings. You agree not to record, screenshot, or otherwise capture meeting content without the prior written consent of Next Key Mortgage. You agree not to share meeting links with unauthorized parties.

9c. No Sensitive Data in Chat

⚠️ Do not share sensitive financial information (SSN, account numbers, passwords) through the Zoom chat function. Use our secure application portal for document submission.

9d. Zoom Platform Terms

Your use of Zoom is also governed by Zoom’s Terms of Service and Privacy Policy. Next Key Mortgage is not responsible for Zoom’s data handling practices.

10. Social Media Terms

Next Key Mortgage maintains official pages on Facebook, Instagram, LinkedIn, YouTube, X (Twitter), and TikTok. By interacting with our social media content, you agree to:

10a. Platform Terms Govern

Your use of social media platforms is governed by those platforms’ own Terms of Service. Next Key Mortgage is not responsible for the policies or practices of any social media platform.

10b. Content Standards

Content posted on our social media pages must not be defamatory, discriminatory, harassing, or illegal. We reserve the right to remove content and block users who violate these standards or applicable platform community guidelines.

10c. No Financial Advice via Social Media

Content posted on our social media channels is for informational and educational purposes only and does not constitute financial, legal, or mortgage advice. Do not make financial decisions based solely on social media content. Always consult directly with a licensed loan officer for advice specific to your situation.

10d. Advertising Disclosures

Paid social media advertisements by Next Key Mortgage will be clearly labeled as “Sponsored” or “Ad” in compliance with FTC endorsement guidelines and each platform’s advertising policies. Lead forms on social media platforms will include all required TCPA disclosures.

10e. Third-Party Content

Shares, reposts, or links to third-party content do not constitute endorsement of those parties or their views. We are not responsible for the content or accuracy of third-party materials.

11. Website Use & Acceptable Use Policy

By using main.nextkeymortgage.com, you agree to access it only for lawful purposes and in a manner that does not infringe upon the rights of others. You agree not to:

  • Use automated tools (bots, scrapers, crawlers) to access our website without written permission
  • Attempt to gain unauthorized access to any portion of our website or its supporting systems
  • Transmit malicious code, viruses, or disruptive data
  • Impersonate Next Key Mortgage, its employees, or any other person or entity
  • Use our website to submit fraudulent applications or provide false information
  • Collect or harvest personal information of other users
  • Post or transmit unsolicited commercial messages (spam)

We reserve the right to terminate access for users who violate these terms.

12. Intellectual Property

All content on the Next Key Mortgage website — including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software — is the property of Next Key Mortgage or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from our website solely for personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any content without our prior written permission.

The Next Key Mortgage name, logo, and related marks are trademarks of Next Key Mortgage. All other trademarks appearing on our website are the property of their respective owners.

13. Disclaimers & Warranty Disclaimer

We do not warrant that:

  • Our website will be uninterrupted, error-free, or secure at all times
  • Results obtained from using our mortgage calculator or other tools will be accurate or reliable
  • Any errors in our website will be corrected
  • Mortgage rates displayed will be available when you apply

Mortgage calculator results are estimates only and should not be relied upon as a commitment to lend. Actual loan terms, rates, and payments will be determined by the lender following full underwriting review.

⚠️ AS-IS BASIS: Our website and services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Next Key Mortgage, its officers, directors, employees, agents, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from:

  • Your use of, or inability to use, our website or services
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on our website or platforms
  • Any other matter related to our services
  • Loan denial, delayed closing, or adverse loan terms resulting from information you provided

In no event shall our total liability to you exceed the amount of broker compensation received by Next Key Mortgage directly in connection with the specific transaction giving rise to the claim.

Some states do not allow exclusion of certain warranties or limitation of certain damages, so some of these limitations may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Next Key Mortgage and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your violation of these Terms
  • Your submission of false or fraudulent information on a mortgage application
  • Your violation of any applicable law or regulation
  • Your infringement of any third-party right
  • Your misuse of our SMS, email, video, or social media services

16. Fair Lending Statement

Next Key Mortgage is an Equal Housing Lender and is committed to full compliance with all fair lending laws, including:

  • Equal Credit Opportunity Act (ECOA) / Regulation B: We do not discriminate in any credit transaction based on race, color, religion, national origin, sex, marital status, age, receipt of public assistance, or exercise of rights under the Consumer Credit Protection Act.
  • Fair Housing Act: We do not discriminate in residential real estate transactions on the basis of race, color, national origin, religion, sex, familial status, or disability.
  • Home Mortgage Disclosure Act (HMDA): We collect and report loan data to federal regulators as required by law.
  • Community Reinvestment Act (CRA): We are committed to meeting the credit needs of all communities we serve.

17. Regulatory Disclosures

NMLS Disclosure

Next Key Mortgage is licensed through the Nationwide Multistate Licensing System & Registry (NMLS). You may verify our licensing and view state-specific license information at nmlsconsumeraccess.org.

RESPA / Regulation X

Next Key Mortgage complies with the Real Estate Settlement Procedures Act (RESPA) and its implementing regulation, Regulation X. We will provide you with required disclosures including the Loan Estimate, Closing Disclosure, and required affiliated business arrangement disclosures.

TILA / Regulation Z

We comply with the Truth in Lending Act (TILA) and Regulation Z, including requirements for clear disclosure of Annual Percentage Rate (APR), finance charges, total loan amount, and total payments.

SAFE Act

All mortgage loan originators employed by or associated with Next Key Mortgage are licensed under the SAFE Mortgage Licensing Act and registered in the NMLS as required.

Affiliated Business Arrangements

If Next Key Mortgage has any affiliated business relationships with settlement service providers (title companies, insurance companies, etc.) that could benefit from your transaction, we will disclose those relationships to you in writing as required by RESPA.

18. Dispute Resolution

18a. Informal Resolution First

Before pursuing formal legal action, you agree to contact Next Key Mortgage directly at info@main.nextkeymortgage.com or (470) 457-6149 to attempt to resolve any dispute informally. We will make good-faith efforts to resolve any complaint within 30 business days.

18b. Binding Arbitration

If informal resolution fails, any dispute, controversy, or claim arising from or relating to these Terms or our services (except for small claims court matters and injunctive relief) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the state of Georgia unless otherwise mutually agreed.

18c. Class Action Waiver

⚖️ Class Action Waiver: You agree that any arbitration or proceeding shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration. This waiver does not apply to claims that cannot be waived by law.

18d. Regulatory Complaints

Nothing in these Terms prevents you from filing a complaint with a government regulatory agency including the Consumer Financial Protection Bureau (CFPB), your state’s banking department or Division of Finance, the Federal Trade Commission (FTC), or HUD.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law provisions. To the extent any disputes are not subject to arbitration, you agree to submit to the personal jurisdiction of the state and federal courts located in Georgia for resolution of any disputes arising under these Terms.

These Terms do not limit any consumer protection rights you may have under federal law or the law of your state of residence.

20. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by:

  • Updating the “Last Updated” date at the top of this page
  • Sending an email notification to registered users
  • Posting a notice on our website homepage
  • For changes affecting SMS consent, sending an SMS notification

Your continued use of our services after any changes become effective constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using our services and notify us to close your account.
